Illinois IEP evaluation deadlines

How long an Illinois school district has — to answer your request, to finish the evaluation, and to meet — with the law cited for every number.

Illinois's clock

The district must respond to a written request within 14 school days (23 Ill. Admin. Code §226.110(c)(3)).

After you sign consent, the evaluation must be finished within 60 school days (23 Ill. Admin. Code §226.110(d)).

Recording a meeting: all-party (meetings governed by district policy) (720 ILCS 5/14-2).

If the school misses: state complaint — allege a violation from the last 1 year (34 CFR §300.153(c)); due process — 2 years from when you knew or should have known (34 CFR §300.507(a)(2)).

Verified Illinois details

  • Written request → within 14 school days the district must decide whether an evaluation is warranted and send you its conclusions plus the consent request — or a written refusal (§226.110(c)(3)).
  • Consent → eligibility decided AND the IEP meeting completed within 60 school days — and if fewer than 60 school days remain in the year, both are due before the first day of next school year. Illinois accelerates to the summer boundary; it does not pause (§226.110(d)).
  • The IEP meeting must also be within 30 days after the eligibility determination (§226.110(j)) — both duties fit inside the 60-school-day envelope.
  • State complaint: 1 year (23 IAC §226.570). Due process: 2 years.
  • Recording: Illinois is a two-party-consent state (720 ILCS 5/14-2) and IEP-meeting recording is district policy — ask in writing, never assume.
