Montana IEP evaluation deadlines

How long a Montana school district has — to answer your request, to finish the evaluation, and to meet — with the law cited for every number.

Montana's clock

State law sets no separate response deadline — federal law governs: the dated written request is still what starts everything, and a refusal must come with prior written notice.

After you sign consent, the evaluation must be finished within 60 calendar days (ARM 10.16.3321).

Recording a meeting: all-party (Mont. Code Ann. 45-8-213).

If the school misses: state complaint — allege a violation from the last 1 year (34 CFR §300.153(c)); due process — 2 years from when you knew or should have known (34 CFR §300.507(a)(2)).
