New York IEP evaluation deadlines

How long a New York school district has — to answer your request, to finish the evaluation, and to meet — with the law cited for every number.

New York's clock

State law sets no separate response deadline — federal law governs: the dated written request is still what starts everything, and a refusal must come with prior written notice.

After you sign consent, the evaluation must be finished within 60 calendar days (8 NYCRR §200.4(b)(1); NYSED Parent's Guide (2025)).

Recording a meeting: one-party (meetings governed by district policy) (Penal Law §250.00).

If the school misses: state complaint — allege a violation from the last 1 year (34 CFR §300.153(c)); due process — 2 years from when you knew or should have known (34 CFR §300.507(a)(2)).

Verified New York details

  • Your written referral IS the trigger — New York sets no district 'response window' for a parent referral, and the chairperson must immediately notify you (8 NYCRR §200.4(a)).
  • Consent → initial evaluation completed within 60 calendar days (NYSED's own Parent's Guide, 2025, states the calendar-day reading of §200.4(b)(1)).
  • Consent → the board must arrange services within 60 school days (30 school days if the recommendation is an approved private-school placement) (§200.4(e)(1)).
  • State complaint: violation within 1 year. Due process: 2 years (Educ. Law §4404(1)(a)).
  • Recording a CSE meeting: no state rule grants or bars it — district policy governs. Ask in writing.
